[Brentwood has chosen to continue with its half of development in what it now calls Dunton Hills Garden Village. This is planned to go ahead without the cooperation of Basildon Council and without providing the further evidence they requested. In these circumstances it is impossible for Basildon to take into account the impact of this development adjacent to its border. This is a significant failure on the part of Brentwood on the Principles of Duty to Cooperate as laid out in the Localism Act. To avoid this Brentwood should either provide the necessary evidence and individual responses to consultation comments to allow the joint proposal to continue, or withdraw its plans to allow housing development on Dunton Hills.]

In 2014 Brentwood asked Basildon through Duty to Cooperate to participate in a consultation on a joint development names Dunton Garden Suburb. The memorandum of understanding stated that the Local Plans of Brentwood and Basildon had a dependency on the Dunton Garden Suburb consultation. It therefore cannot be considered in isolation of the local plan preparations.

The result of the Dunton Garden Suburb consultation was overwhealming opposition to the proposal. This was not only in terms of the number of people who objected but more importantly it was demonstrated by the validity, reason and quality of the many diverse objections raised. It was Brentwood Council's responsibility under the Memorandum of Understanding to provide responses to the representations in the consultations, but they only provided brief and inadequate responses to a selection of points raised. These were provided in the Statement of Consultation. Most of the valid objections made were left unanswered when the Memorandum of Understanding expired.

Basildon council stated that the joint proposal could not go further unless Brentwood provided more evidence. Apart from the many objections raised it can be noted in particular that no green belt review has been carried out in Brentwood to justify releasing the large area of green belt at Dunton Hills.

Despite these failings, Brentwood has chosen to continue with its half of development in what it now calls Dunton Hills Garden Village. This is planned to go ahead without the cooperation of Basildon Council and without providing the further evidence they requested. In these circumstances it is impossible for Basildon to take into account the impact of this development adjacent to its border.

This is a significant failure on the part of Brentwood on the Principles of Duty to Cooperate as laid out in the Localism Act. Proper adherence to this principle is an important part of preparing a sound local plan and its failure must be seen by the planning inspectorate as totally unacceptable. To avoid this Brentwood should either provide the necessary evidence and individual responses to consultation comments to allow the joint proposal to continue, or withdraw its plans to allow housing development on Dunton Hills.

Thurrock Council requests that more detail is provided as to how such Green Belt release is to be undertaken and how alternative locations have been considered before a further draft Local Plan consultation. It is considered the role and development of the A12 corridor and in particular Brentwood/Shenfield Broad Area should be thoroughly investigated and its potential role to accommodate further growth over the period of the local plan and beyond. The implications of the potential to accommodate more growth and associated infrastructure requirements need to be considered with some weight as a way of meeting the housing requirement currently identified in the Brentwood Local Plan Growth Options and supporting evidence.
Thurrock Council has a fundamental objection to a strategic Green Belt release at Dunton Hill Garden Village or at West Horndon due to the impact on the Green Belt. In addition limited new or updated evidence has been made available to demonstrate the deliverability and viability of such schemes.
Thurrock Council has also highlighted various aspects of concern with the evidence base in connection with the preparation of the draft local Plan.
Thurrock Council wished to clarify that its objections to the earlier consultations to the Brentwood Local Plan and Dunton Garden Suburb stage still stand. Due to the issues highlighted in this response and to the earlier documents there are several fundamental concerns to the strategy approach and detail development proposals it is considered that Brentwood Council needs to carefully consider how it proceeds with the preparation of the Local Plan and the timetable for its production.

It is unclear from the local plan and supporting documentation how the Council has engaged with the Mayor of London and the London boroughs on the matter of migration. The inspector for the London Plan, in his report (dated 18 November 2014), does refer to this effect. He notes that the Mayor's SHMA "includes assumptions relating to migration...likely to be material to the preparation of local plans outside London."

Paragraph 2.10 of the OAN report does acknowledge the potential problem of London but states that it is unable to assess the implications of the Mayor's new plan until this adopted. The report therefore implies that the OAN figure of 360 dpa is very much a provisional one.

Need for Showmen's Yard
National Planning Guidance states plot targets should be set, working collaboratively with neighbouring LPAs. We consider there is a need to ensure the provision of travelling showpeoples yards in neighbouring areas to Thurrock, where no specifically known need has ever been identified but actually exists and is under reported.

We consider that suitable sites for showmen's yards, such as our clients [Land at Chequers Public House, Chequers Road, South Weald], should be discussed as part of the Duty to Cooperate bearing in mind that at present, Thurrock is expected to provide for over 90% of the future need for such yards to the period 2033, but this is contrary to the desires of the actual community.

Thank you for inviting Rochford District Council, as a Local Planning Authority in a neighbouring Housing Market Area, to submit comments on Brentwood Borough Council's Draft Local Plan 2016. Rochford District Council recognises that this is the first formal stage in the development of Brentwood's local development plan and therefore welcomes the opportunity to provide comments at this early opportunity.
The A127 - alongside the A130 and A13 - forms part of the strategic road network for South Essex serving as a key route for residents and businesses living in the District and surrounding areas. It is therefore imperative that any development proposed in proximity to any of these corridors, is accompanied by adequate mitigation measures to the strategic road network.
Two strategic development sites are proposed within the vicinity of the A127 corridor to the south east and south west of the Borough. However, it is unclear from the Draft Local Plan 2016, what mitigation measures would be required to accompany significant development in this location. It is therefore strongly recommended that any future iterations of Brentwood's new Local Plan are clearly accompanied by appropriate mitigation measures, to ensure that any proposals would not have a detrimental impact on the A127 in particular.
Rochford District Council would welcome opportunities to engage with Brentwood Borough Council on strategic planning matters - particularly in relation to meeting housing needs and highways impacts - through the Duty to Co-operate as both Local Planning Authorities continue to progress and review their respective local development plans.

The proposed Dunton Hills Garden Village would be located on the Brentwood/Basildon border. Whilst Brentwood and Basildon Borough Councils jointly consulted on Dunton Garden Suburb in January 2015, Brentwood have decided to take their portion of the potential development forwards separately. This is despite the emerging Basildon Borough Council Local Development Plan incorporating the "Dunton Extension" which would see at least 5.5ha of land west of Basildon allocated for mixed use development.
Whilst separating the two developments may in theory improve deliverability, it raises serious concerns around sustainability when the total area is considered together. Brentwood Borough Council must work with Basildon Borough Council to ensure that any development within and around the border is developed holistically, with sufficient infrastructure provided.

Reliance is being placed on the Dunton Hills GArden Vilalge for significant numbers of the housing provision over the life of the plan. There is no published evidence that the Duty to Cooperate with Basildon is being fulfilled to progross plans and firm up proposals. Basildon states that "Brentwood Borough Council has not provided sufficient information, at this time, to show it is the best location for new housing provision in the Brentwood borough". Information on engagement with London and London brooughs is also lacking.
Therefore it is not clear to what extent authorities with whom Brentwood Borough has a connection have been engaged and are agreeable to such an approach. This issue is particularly pertinent given the strong relationship between Brentwood and London, and the latter's acute housing need. We question whether the approach currently being taken in the preparation of the Local Plan meets the Duty to Cooperate.

The Council does not appear to have taken the representations to the 2015 consultation conscientiously into account as identified in the Statement of consultation 2016 and, in particular, failed to consider the legitimate criticisms of the way in which strategic Green Belt sites have been evaluated and chosen. The Council has failed to take into account the concerns raised by neighbouring authorities in this regard.

Representation Summary:

The duty to cooperate provides a mechanism for strategic matters to be addressed to ensure that development needs are planned for on a wider than local basis. Moreover it enables local authorities that are confronted by particular environmental and geographic constraints to address their development needs, inline with Paragraph 182 of the NPPF. In summary, national policy and guidance is clear that a local plan should:
prepare a SHMA to assess full housing needs
provide a delivery strategy that is clear in terms of where, when and how housing need will be delivered over the full plan period
meet full, objectively assessed housing need for market and affordable housing
meet the legal duty to cooperate and incorporate allowances for unmet requirements from neighbouring authorities where it is reasonable to do so; and
boost significantly the supply of housing and ensure a deliverable five year housing land
supply with an appropriate buffer can be maintained at all times.
