Some of these would need to be in the conservation area to address flood risks, and that would have to be considered before work could be committed. I am unable to say whether these modifications would make the plan sound, sustainable , to even financially viable, as no such evaluation has been made.

The proposed housing developments in Blackmore (R25 and R26) are not sound. They are not based on relevant and appropriate evidence relating to their impact on the village of Blackmore. In particular, they ignore the impact of the development on the risk of flooding from surface water runĀ­ off in the central Blackmore area around the Green, and the adequacy of existing infrastructure to deal with the increased demand for services, roads, sewers and other public services).

Taking each of the criteria for soundness, the proposals fall short on each one.
* The Local Plan is not positively prepared. The local plan ignores the critical dependency on flood risk in central Blackmore, the capacity of the sewers underneath the Green to deal with excess surface water in that area, and the capacity of the local country road system to deal safely with higher volumes of traffic.
* The Local Plan is not justified. It is not clear why a site that increases the risk of flooding in a Flood Risk Zone 3 area and places unsustainable pressure on local services is considered preferable to alternative sites.
* The Local Plan is not effective. It is highly unlikely that a sustainable development can be delivered in the timeframe with the additional improvements that would be needed for it to be successful for existing and new residents of Blackmore.
* The Local Plan is not consistent with National Planning Policy. This is because it does not consider the increased flood risk, and pressure on local infrastructure, and is therefore not sustainable. Climate change will exacerbate this risk.

Supporting Evidence for these comments
The evidence presented in support of the proposals includes the Strategic Flood Risk Assessment Report (SFRA). Appendix A identifies the area south of the Green and around the river as being in Flood Risk Zone 3, an area of high risk of flooding. At first glance some may assume that it is simply proximjty to the river that causes this risk, however this is not the case. The most significant risk arises from the particular topography of the Blackmore area and how water collects and moves through the area. The introduction of c 100 new houses with associated hard standing areas to the North of the Green will seriously increase flood risk to the South of the development, both around the Green and the Church.
Central Blackmore is in a shallow basin that collects water from the upper tributary system of the River Wid. This situation, and the heavy clay soils of the area, means that after periods of persistent rainfall, the surrounding fields become waterlogged, and rapid run-off of surface water occurs, filling the roads leading into the Green and the Church. The direction of water movement is to the South, along the course of the river down to Wen locks Farm, but this is narrow, and when the run-off is high in volume, the water backs up in the Green. Other concentrations of water can occur around the Church, and pour from Church Street down towards the Green. The volume of water in the roads around central Blackmore can become dangerous very quickly. However, a less obvious but critical vulnerability is the sewer system underneath the Green.

On 23rd June 2016, following a period of persistent and heavy rain, the above scenario occurred, and the volume of water overwhelmed the pumping station next to Jericho priory, which services the sewerage system. This caused the sewers under the Green to be overloaded, reversing the flow of foul water into the properties along the Green. While several properties reported water backing up through toilets, unfortunately my own house, , was the line of least resistance, and experienced disastrous flooding, although this did draw some of the water away from neighbouring properties. I have now taken steps to improve the flood defences of my property given its particular situation, but this does not reduce the risk to all the properties collectively, as excess water has to flow somewhere. This illustrates clearly the vulnerability of properties in central Blackmore to surface water flooding and the risk of the sewerage system being overwhelmed. I enclose photographs of the situation in the Green on the morning of the 23rd June 2016, and the flooding in as an illustration of what can happen.

The creation of two new housing developments in Blackmore to the North of the Green will lead to an increased risk of surface water run-off into the basin around the Green and the Church. My understanding is that Brentwood Borough Council plans to ask the property developer to consider flood risk in the development, but the reality is that it is beyond the control of the property developer to address this situation from the area in which they are building. I know from my own experience that the standard solution to drainage, being the installation of soakaways, does not work effectively in clay soils, especially when the volume of water builds up quickly. The alternative sometimes taken when soakaways fail is to route surface water into the sewerage system. This only leads to the results described above, and may be challenged as to its compliance with building regulations. I can provide additional details of these matters if necessary. Please note that individual insurance claims for flooding can result in six figure claims, so this is likely to be a very material consideration for the feasibility of these developments for the Council and the Developer.

This is a critical dependency that should be considered at the planning stage if mistakes are to be avoided. It is not acceptable to leave this problem with the builder, but must be addressed before it goes any further.
I have commented that the proposal may not be legally compliant. I am not a lawyer, but it seems odd that a proposal could be brought forward which increases the risk of flooding to a high risk area, without a proper risk assessment at the initial stage. As noted above, it is unclear to me how planning regulations could be complied with in a way that will manage flooding risk appropriately, without expanding the scope of the work to include major remedial works to infrastructure in a conservation area. The situation regarding road safety is also critical, but again there is no consideration of work that may be necessary in the conservation area to protect motorists, cyclists and pedestrians from increased traffic on narrow roads liable to flooding. The requirements of the Conservation area would have to be considered before remediation work could be committed. It may not be possible to remediate these matters, and it would be negligent in my view not to find answers to these questions before the proposal moves to the next stage.

Significant remediation work would be necessary to rivers, drainage, sewers, and roads, if the proposals were to be sustainable. Some of this work would need to be in the Conservation Area, for example the modernisation and expansion of sewers under the Green, and the course of the river South of the Green. Remediation work could affect the historic nature of central Blackmore, and its effect on the Conservation area would have to be considered before that work could be committed. There has been no evaluation of these matters, so it is hard to know how much this would cost, but it seems likely to be significant, hence the central message that the proposals are unsound.

a) Local Plan has not been positively prepared
There are many developments in the area that have been recently completed or are in the construction process. These include, but are not limited to, the development at the end of Thrifts Hall Rod which has in excess of 30 houses already. There is another proposed development near Nine Ashes Road along with a further 9 houses at the end of Spriggs Lane. These developments are and will cause a great strain on the Villages resources and compromise the safety of the area. The people who occupy these homes will be using the school and doctor's surgery, both of which are already struggling with capacity. In the case of the surgery it is already a challenge to get an appointment and the school is already oversubscribed. As well as these issues the surrounding roads are not designed for the extra traffic that the development will bring. The roads in the area are narrow and dangerous.
One example of this is Red Rose Lane which is so narrow in parts that it is only suitable for one car at a time and struggles with the current usage. This will only become become more dangerous with extra traffic. This is not a sustainable development that will seriously damage the quality of life of the residents in the Village.

b) Local Plan is not Justified.
I believe that other alternatives have not been taken into account. A Brownfield site in Stondon Massey which is capable of holding 70 houses has been proposed by the village, however, this has not been considered. This site is on offer but there has been a move to destroy the Greenbelt instead.

c) Local Plan is not Effective
There is no clear strategy for the Village and it is under threat of being overwhelmed. Another site in Honeypot lane was withdrawn due to poor access and the fact that it is on the greenbelt. This is also the case with the proposed Blackmore sites which should also be withdrawn for this reason. I passionately feel that this is just to create more housing to fit in with the government requirements and there has not been serious consideration to how this will affect the safety and quality of life of the current residents.

d) Local Plan is not Consistent with National Planning Policy
This proposal is entirely developer led with no plan on how to make this a sustainable proposal. The amount of development planned for the small Village of Blackmore is not justified with the current resources of the area. There has been no workable plan to prove how the Village of Blackmore is supposed to cope with the large influx of extra tenants to the area, which has had a proposal of twice the amount of development of other villages. The village is unsuitable for several reasons including, but not limited to, flooding, poor access, overcrowding and lack of services in the area. This plan is a farce to cover up for a lack of action taken by the BBC to deal with the perceived housing need.

Appendix to question 5

Fields are already subject to flooding whish e already have problems with in other parts of the village. Proposal is on Green Belt land and in a conservation area of great natural beauty.

We have visitors to the village which are welcomed and they use the businesses, but other are racing through our village to get to the 414 and M11 etc when there are accidents breakdown on the A12 and exit at the Mountnessing roundabout.
11. At a recent meeting at our village hall where BBC planners attended, they refered that Lanes were Roads; this is not the case. They are lanes with ditches either side and difficult to drive down hoping that no-one meets you coming the other way. These lanes are used by horse riders, cyclists and cyclists who race and belong to clubs and Blackmore is a favoured venue for these cyclists.
Sites R25 and R26 should be removed from the LDP and planners should refer to the BVHA Neighbourhood Plan which clearly sets out our local housing needs for our sustainable community.
Reason for appearance: I want to keep the unique village as it is. Have lived here for 40 years and do not want it spoilt.

BBC has not carried out a local survey recently relating to current housing needs of Blackmore village. BBC has no clear strategy for its villages and has not considered the available brownfield sites which are there and should take priority over development of greenbelt. The development is led by developers not thought through by BBC. I feel as though the Plan is unsound, is not legally compliant and fails to comply with the duty to cooperate for sites R25 and R26 for the following reasons: 1. 1. Brentwood Borough Council failed to consult with neighbouring authorities i.e. Epping Forest District Council regarding 30 dwellings at the top of Fingrith Hall Lane and its impact on our village. The people use our facilities in the village.
2. No clear strategy for the village including Blackmore in the north of the Borough.
3. To have a residential development off Red Rose Lane is totally wrong - Blackmore is an isolated unique village with modest services and infrastructure. Also, this is a lane and not a road.
4. There must be other more suitable and/or sustainable locations e.g. urban extensions to Brentwood to the locations in Blackmore do not promote sustainable development.
5. BBC has not demonstrated that there are other brownfield sites that are available which take priority over Green Belt land off Red Rose Lane before grabbing Green Belt land as an easy option which would benefit the developer.
6. No housing need survey has been conducted for our village to demonstrate why Blackmore has been included in the LDP.
7. Blackmore has a history of flooding so would be concerned that more housing would further increase the flood risk elsewhere.
8. Our school is full. My grandchildren who live in the village are driven to another school everyday 2 miles away. Also parents driving children to school cause chaos each day with inconsiderable parking and annoying local residents when using their roads to park.
9. Our doctor practice is full, have trouble now getting appointment.
10. The traffic using our village has increased in the last 10 years and is now horrendous. The residents cannot park in the centre f the village to shop because there is no parking available. We have visitors to the village which are welcomed and they use the businesses, but other are racing through our village to get to the 414 and M11 etc when there are accidents breakdown on the A12 and exit at the Mountnessing roundabout.
11. At a recent meeting at our village hall where BBC planners attended, they refered that Lanes were Roads; this is not the case. They are lanes with ditches either side and difficult to drive down hoping that no-one meets you coming the other way. These lanes are used by horse riders, cyclists and cyclists who race and belong to clubs and Blackmore is a favoured venue for these cyclists.

The proposal does not take into account the increased housing from areas of private development within Blackmore. Blackmore is small village of historical importance and character. My concerns relate specifically to the sustainability of Blackmore's inclusion in the Local Plan. My points relating to Blackmore are shown on the attached type sheet below. 1. GP services are already badly stretched. It take three to four weeks to get a non-emergency appointment. A higher population will strain this service to breaking point. 2. Blackmore is already prone to flooding. Building on greenfield / Green Belt land can only worsen this situation by reducing the available drainage areas. 3. The only parking available in the village, other than by the village hall, which is a long walk from local facilities, is along the narrow roads. These are already becoming full of parked vehicles. 4. As a small village, many of Blackmore's roads, in particular in the Redrose Lane area, are not much more than narrow lanes with no footpaths. The roads cannot support additional traffic resulting from increased housing, let alone construction traffic. 5. Transport links from the village to town are poor, with the bus service permanently under threat. This forces people into their cars already, without adding to the burden. Blackmore is too far away and cut off from the town centre and railway stations to be of benefit to new residents wishing to work in town or commute elsewhere. 6. There is no proven need for more housing this far away from the town. 7. The proposed development is on Green Belt land when there are Brown Belt area more usefully located closer to Brentwood and Shenfield. 8. The proposal does not take into account the increased housing from areas of private development within Blackmore. 9. Blackmore is small village of historical importance and character. A 30 odd house development is already being built and other proposed sites e.g. Woollard Lane are "permission pending". The proposed development of 90 plus houses is far too many for the existing infrastructure, particularly Red Rose Lane for traffic 'and often local roads, doctors surgery is barely able to cope with the existing numbers and new classrooms would be needed in the local primary school. As Princess Ann supported a few years ago, if every village was about to build 4-5 houses, then local needs could be met and absorbed. BBC has not proposed this in other villages within its authority.
