Local Plan 2015-2030 Preferred Options for Consultation

Representation ID: 402

Received: 02/10/2013

Respondent: JTS Partnership LLP

Representation Summary:

This policy needs to be substantially reviewed so that it accords with NPPF guidance and is therefore unsound. Paragraph 89 of the NPPF makes it clear that the following classes of development may be appropriate in the Green Belt:- the extension or alteration of a building provided that it does not result in disproportionate additions over and above the size of the original building.

The way that the policy is currently worded, suggests the Council will only grant permission for residential extensions in the Green Belt in 'very special circumstances'.

Representation Summary:

This policy needs to be substantially reviewed as it is inconsistent with NPPF guidance and, accordingly, is unsound. The way that the policy is currently worded, suggests that the Council will only grant permission for residential extensions in the Green Belt in 'very special circumstances'.
Clearly, however, 'very special circumstances' do not need to be proven for appropriate development - i.e. an extension or alteration to a residential building that does not result in a disproportionate addition. The policy must be reworded to reflect NPPF guidance (Paragraph 89).

Local Plan 2015-2030 Preferred Options for Consultation

Respondent: Ingatestone and Fryerning Parish Council

Representation Summary:

a. The first sentence refers to very special circumstances but these are not defined. We believe that the sentence should read "Proposals to extend dwellings within the Green Belt will not be permitted unless al the following criteria are met or very special circumstances are demonstrated". We think this is clearer and will avoid confusion.

criteria b- we are concerned that extensions of 30% to large properties could represent significant intrusion into the Green Belt and thereby affect its openness. Whilst we appreciate that criteria c. will give some protection we feel that some way of setting a maximum size should be seriously considered rather than a straight percentage figure which could give some properties too little and some far too much.
