We note the Council's wish to adopt the nationally described space standard through the new local plan. The Council will need to justify this by meeting the tests set out in the relevant section of the NPPG. The tests are ones of necessity, viability, and the impact on affordability including the supply of starter homes.

Para 7.70 - 7.72 set out the Borough's rationale but this does not address the evidence requirements from the PPG that requires evidence on properties currently being built, the potential impact on demand for starter homes and the potential impact on land supply and viability. Without this evidence base the policy should not be applied across all housing types.
It is likely to impact the viability of our client's site [within the allocation for Dunton Hills Garden Village] but affordability is also an issue, as is the need to ensure that there is proper mix of provision that delivers across a whole variety of different needs. Whilst the policy states this policy will be subject to viability, the NPPF requires local planning authorities to assess for viability at the plan making stage.

Policy 7.8 seeks to set out the nationally described space standards within a Local Plan policy. As required by the PPG, LPAs should consider the impact of using such national standards as part of their Local Plan viability assessment. No evidence has been presented to demonstrate this, and no justification is provided on the appropriateness of adopting such standards.

In order to require internal space standards, LPAs have to take into account need, viability and timing, supported by evidence.
There does not appear to be evidence of work undertaken by Brentwood Council which asses the need, viability and timing of adopting internal space standards. It is unclear as to the rationale for the need of this policy; the impact upon the viability of development alongside the cumulative impact of other policies that place a financial burden on the development and the policy is silent on timing and any transitional period. For these reasons, policy 7.8 is considered unsound.
